2/5 – In the first major copyright infringement case since the Supreme Court’s Warhol ruling, a jury unanimously ruled that Kat Von D’s hyper-realistic tattoo a photograph of Miles Davis did not violate copyright law. Photographer Jeff Sedlick sued Von D for a tattoo she created for a friend of hers that was subsequently used in her social media posts promoting her (now shuttered) studio High Voltage Tattoo and in the reality series Miami and LA Ink. After staying the case pending the outcome of Warhol, the court sent the case to the jury, which held that Von D’s tattoo was not similar enough to the photo of Miles Davis to constitute copyright infringement, and also that it was protected under the fair use doctrine.
