6/27 – In the latest First Amendment case to hit the Supreme Court’s docket, the Court rejected a claim from the attorneys general of Missouri and Louisiana, along with a group of doctors, the owner of a right-wing conspiracy theory website and an anti-virus advocate, who sued the Biden administration for its communications with Facebook urging the removal of posts about the Covid-9 vaccine and claims of election fraud. The 6-3 decision was based on plaintiffs’ inability to prove “standing” — i.e., sufficient injury — and leaves unanswered the fundamental question about the scope of First Amendment protection for the actions (or inactions) of tech companies.
